In Trump’s first term, the Democrats enjoyed the majority position in the House of Representatives. This advantage made holding up Donald Trump’s initiatives very straightforward. They did not have to sue him in court to slow him down. They just made up reasons to Impeach the 45th President and have him spin his wheels defending himself in Congress. The House, under the leadership of Nancy Pelosi and with the drive of Adam Schiff, impeached Donald J. Trump, not once, but twice, making him the only U.S. President impeached twice.
The time, energy, and resources expended by Trump to survive these two impeachments, plus the COVID-19 pandemic, prevented Trump from achieving many of his goals. However, his resilience and the unwavering support of the MAGA movement were truly inspiring. His defeat by Joe Biden in 2020, which ended his political run, at that time, may have been the best thing for Trump and the MAGA movement, if not for the country. America had to endure four years of the feckless Biden/Harris administration, but the malaise developed a thirst for Trump’s policies. People realized the mistake they made by allowing the Democrats to take us further to the Left, and they wanted a return to normalcy and common sense. Trump offered them both, and the four-year break gave him time to recharge, plan, and be ready to make the most of a second bite at the apple. The pace of the Trump White House in the first 100 days is dizzying and exciting to watch for those on the Right. The Left has no answers and must resort to impeding Trump in every way. Democrats do not have the numbers in Congress to use the impeachment play again, although Al Green missed that memo. So they are going to Plan B, which is to use the courts for speedbumps.
One thing Biden did accomplish in his term was to fill the courts with extremely radical judges. This move, which may have gone unnoticed by many, is a cause for concern. He had the Senate on his side, and though every candidate he nominated was grilled and embarrassed by Republican Senators, the numbers were there for Biden to get his picks approved. Biden appointed 187 judges to the federal district courts, which handle criminal and civil trials, and 45 judges to the federal appeals courts, which handle appeals of cases decided in district courts. He also appointed one justice, Ketanji Brown Jackson, to the Supreme Court, which has the final word on federal legal appeals. The Democrats are now using these activist judges to stop Trump.
Trump’s return to the Oval Office in January has brought more than 132 lawsuits from activists, government employees, and others targeting his executive orders and actions. The lawsuits have resulted in nationwide injunctions in some cases, including 15 in February alone. By comparison, there were only 27 injunctions filed against all Presidents in the 20th century. The latest injunction last weekend brought by U.S. District Judge James Boasberg involving the deportation of terrorists back to Venezuela shows the extreme nature and danger of these legal actions. Boasberg attempted to stop the flights of three planes carrying known terrorists rounded up by ICE and the DOJ, which Venezuela agreed to accept and reincarnate. This judge was imposing his power over a national security activity directed by the Commander in Chief. His involvement of the ACLU in his attempt made the judge’s action purely political. If allowed to stand, the action by Judge Boasberg would establish a precedent where the courts would need to approve the President’s actions to keep this nation safe. This case is ongoing with both sides showinng no signs of yielding. It will undoubtedly be fast-tracked to the Supreme Court, which may be good in the long run for Trump. These lower court rulings will not cease until the high court reigns them in.
